End User License Agreement (EULA)

ENTITY: APEX BORE-STRIKE

1. GRANT OF HARDWARE-LOCKED LICENSE

Subject to the payment of the applicable annual licensing fee, APEX BORE-STRIKE grants you a limited, non-exclusive, non-transferable, and revocable license to execute the software (".exe"). This license is cryptographically bound (via RSA encryption) to the specific physical hardware UUID(s) authorized during procurement. Virtual Machines (VMs) and hardware spoofing will void the cryptographic seal.

2. THE LIABILITY SHIELD (ASSUMPTION OF RISK)

APEX BORE-STRIKE is an algorithmic diagnostic and mathematical advisory tool. It processes Bingham-Plastic fluid dynamics and Delft Cavity Expansion limits based strictly on the telemetry manually inputted by the operator. We assume ZERO liability for physical execution.

The operator and their respective corporate entity assume 100% of the risk, liability, and physical consequences of horizontal directional drilling operations. APEX BORE-STRIKE shall not be held liable for environmental frac-outs, equipment failure, EPA/DOT fines, site damage, or operational downtime under any legal theory.

3. INTELLECTUAL PROPERTY & REVERSE ENGINEERING

The proprietary O(1) Reverse-Yield Solver, internal lithology matrices, and underlying source code are the exclusive intellectual property of APEX BORE-STRIKE. You may not decompile, reverse engineer, disassemble, or attempt to derive the source code. Unauthorized distribution of FIPS-140 manifest structures or executable binaries will result in immediate license termination and legal prosecution.
